The costs of the program are different per county but in Philadelphia it’s approximately $175.00 plus $125 for alcohol highway safety school. If you had a valid license, insurance and registration at the time of arrest and have no prior record you are eligible for ARD. Under these circumstances you can enter a plea of nolo contendre (no contest) and be ordered to attend an evaluation where the you would lose the right to drive anywhere from 30 to 90 days, be subject to alcohol highway safety school (1 or 2 days) and no conviction. You would be subject to approximately 1 yr probation. As long as all the requirements are completed and there are no new arrests the DUI would be dismissed. At that point we can even file a motion to expunge the arrest record, thereby making the DUI record virtually disappear. All DUI’s in Pennsylvania absent the ARD program require mandatory jail time, except a first offense under .08. 1st offenses may be 48 to 72 hrs and probation, minimum $1000 fine and 1 yr to 18 months license suspension. 2 and 3rd offenses may by 90 days to 1 to two year jail sentences.
