Bail amounts range from $1,600 to $5,000 dollars. Fines range from $390 to $5,000 dollars including penalty assessments of 70% are attached all court-imposed fines.  Additional charges include Restitution fees which can range from $100 to $10,000 dollars.   Jail time ranges from 48 hours to 1 year for misdemeanors, and 5 days to 5 years for felonies. Probation is usual which includes mandatory substance abuse assessment and treatment programs which you the defendant pay for.

In California your license can be suspended for four months for a first DUI. The majority of the states usually suspend for 90 days as opposed to the 4 month time frame.  Georgia comes in at number with a 1 year suspension for a first DUI.

1) Most drivers who have had something to drink have low blood alcohol content (BAC) and few are ever involved in fatal crashes That’s why charging at the legal limit of .08 is inefficient; the problem isn't caused by these drivers but by those with very high BACs. The founder of Mothers Against Drunk Driving argues that we should go after the dangerous drivers and not waste time and money going after those with little probability of causing accidents.

Remember DUI is not necessarily Drunk Driving.  It is quite literally Driving Under the Influence. I can’t tell you the amount of clients who come to me and say, “but I wasn’t drunk.” And at .08 or .09 they probably weren’t but again they were over the DUI legal limit.

2) A good general guideline for most people is to limit consumption of alcohol beverages to one drink (beer, wine, or spirits) per hour. Consuming no more than one drink per hour tends to maintain a low blood alcohol content level. Eating food and snacks (especially those high in protein) is also a good idea.

3) We now have a 40-to-1 greater chance of being struck by a sober driver than by a drunk driver.

4) A typical glass of red or white wine, bottle of beer, or drink of spirits (rum, whiskey, tequila, etc.) each contains almost identical amounts of pure alcohol.
